Part XXVII — Bwari Area Council FCT Abuja, Nigeria — 16th May 2022Pursuant to the provisions of Section 7 and the Fourth Schedule to the Constitution of the Federal Republic of Nigeria 1999, Sections 55 and 56 of the Local Government Act, Laws of FCT Abuja 2006, and other enabling laws, the Bwari Area Council makes this Bye-Law governing rates on borehole drilling and the sale of water to the public.
Annual Rates
Rates payable by drilling companies, water producers, and water retailersBorehole Drilling Companies
₦500,000 – ₦1,000,000
Annual rate depending on company size; payable by the drilling company
Bottled / Sachet Water Producers
₦30,000 – ₦50,000
For persons/companies producing or distributing bottled/sachet water for public sale, annually
Water Retailers
₦9,000
Annual rate for persons/companies selling borehole water to the public
Offences & Penalties
Consequences for non-complianceWhere it becomes evident that an individual or corporate body is unwilling or refuses to pay the rates specified, it shall be an offence under this Bye-Law. Any person who contravenes the provisions shall be guilty of an offence and liable as follows:
Fine of ₦50,000 in addition to the actual amount owed
Fine of ₦150,000 in addition to the actual amount owed
Inspection Powers & Applicability
Entry rights and scope of the Bye-Law- The provisions of this Bye-Law apply to all natural and artificial persons operating within the jurisdiction of the Bwari Area Council.
- The appropriate officer or agent of the Bwari Area Council shall at all working hours of any day have the power to enter any premises — whether residential or commercial — for the purpose of inspection.
Definitions
- "Sale of water" includes manufacturing, producing and selling water to the public.
- "Drilling borehole" includes drilling of the soil mechanically via machines for the purpose of pumping water.
- "Council" includes Bwari Area Council.
