Wrong Parking & Corporate Parking Permit Bye-Law — No. 23 of 2016

Part XXIV — Bwari Area Council FCT Abuja, Nigeria

Pursuant to the provision of Section 7 and the Fourth Schedule to the Constitution of Nigeria 1999, Sections 55 and 56 of the Nigerian State Local Government Laws of 1976, and other relevant sections of the Local Government Act, Laws of the FCT Abuja 2006, the Bwari Area Council hereby makes the following Bye-Laws.

It shall be an offence for any person, corporate body, or institution to park or abandon any car, truck, trailer, heavy duty vehicle, equipment or machine in any place other than an approved place within the Area Council.

Corporate Parking Permits

Sections 2 & 3 — Permits, Fees & Notices

Corporate bodies and institutions within Bwari Area Council shall obtain the necessary permit/license from the Council upon payment of the prescribed fee as listed in the Schedule to this Bye-Law.

Notice of Demand

  • The rating authority shall give notice of every fee demanded and of the day on which such fee becomes due and payable.
  • Notice may be given by direct service on the corporate organisation, by affixing a copy in a public and conspicuous place within the Area Council, or by publishing in one or more daily newspapers circulating in the Area Council.
  • Any person liable to pay for a permit/license shall pay the amount due not later than 21 days or any other date specified on the demand notice.

Impoundment & Recovery of Vehicles

Sections 4 & 6 — Towing and Release Procedures

Where a vehicle (car, truck, tanker, trailer, or heavy duty equipment) is parked or abandoned in an unapproved place within the Area Council, such vehicle shall be impounded and towed to the premises of the Area Council.

Recovery Process

  • The owner of an impounded vehicle is entitled to recover it upon payment of the prescribed fees in the Schedule to this Bye-Law.
  • An additional ₦1,000 is charged for every subsequent day the vehicle remains on the Area Council premises.
  • Vehicles parked on highways or obstructing the free flow of traffic are also liable to impoundment.

Penalty for Non-Compliance: Any person who without lawful justification refuses to obtain a permit shall be liable to a fine not exceeding double the sum owed. Failure to pay amounts due also makes the defaulter liable for accumulated rates for up to the last three years.

Parking Fees & Regulations

Section 7 — Authorised Car Parks

A minimum parking fee of ₦10,000 per vehicle monthly and a maximum of ₦1,500,000 per vehicle (depending on vehicle type) shall be payable for use of any authorised car park between 6:00 am and 6:00 pm. Users must obtain an official ticket and produce it to park wardens on demand.

Obstruction of Officers: Any person who obstructs an authorised officer in the discharge of duties under this Bye-Law is guilty of an offence and liable on conviction to a fine of ₦50,000 or six months imprisonment, or both.

Council Responsibilities

Section 8 — Obligations of the Area Council
  • Provide and maintain parking lots and develop truck terminals and high-rise parking facilities.
  • Charge fees on private commercial parks and on parking lots or facilities provided by the Council.
  • Issue permits for private parking development and take necessary steps to facilitate it.
  • Provide suitable facilities for the removal of vehicles contravening this Bye-Law.
  • Maintain proper records containing particulars of each removed vehicle, date of removal, and the parking facility where it is kept, as required under the Road Traffic Act.

Exemptions

Section 10 — Vehicles Exempt from this Bye-Law

The provisions of this Bye-Law shall not apply to the following types of vehicles:

Ambulances
Fire Service Vehicles
Hearses
Refuse Collection Vehicles

Definitions

Section 12 — Key Terms
"Approved Car Park" Includes motor parks, private parking lots, or any other place(s) designated by the Area Council.
"Authorized Person" Area Council traffic officers, park wardens, police officers, designated officials, and such other persons as the Area Council may appoint.
"Highway" Includes any road, street, crescent, or alley to which the public have access.
"Vehicle" A mechanically propelled vehicle intended or adapted for use on roads, including motorcycles.
"Obstruct" To hinder, prevent, impede, or make accomplishment of duties imposed under this Bye-Law difficult or slow.
"Court" The Magistrate Court of any grade having jurisdiction under this Bye-Law.

Citation & Commencement

Operational Date — 5th January, 2016

This Bye-Law may be cited as the Wrong Parking, Corporate Parking Permit/License Bye-Law 2016 and shall become operational from the 5th day of January, 2016.
