In accordance with Section 7 and the Fourth Schedule to the Constitution of the Federal Republic of Nigeria 1999 (as amended), and relevant sections of the Local Government Act, Laws of FCT Abuja 2006, the Bwari Area Council promulgates this Bye-Law.

No person shall display an advertisement within Bwari Area Council without a permit issued by the Area Council.

Permit Provisions

Issuance, validity, renewal and refusal
  • A permit may be obtained from the Area Council on application (Form A) upon payment of the fee prescribed in the First Schedule.
  • The permit shall be signed by the Council Manager on behalf of the Area Council (Form B).
  • Any permit issued shall expire on 31st December of the year of issuance.
  • Permits shall be renewed annually on payment of the prescribed fee (Form C).
  • An application may be refused on grounds set out in Form D or E — including non-disclosure of business type, failure to submit drawings, and obstructing traffic signs.
  • The Area Council may revoke or modify a permit when expedient and shall issue a notice (Form F) to that effect.
  • The Area Council reserves the right to reject any obscene language appearing on any advertisement.

Temporary Advertisements

Events, entertainment, fairs and circuses
  • A temporary permit may be obtained for advertisements relating to a visit, travel, circus, fair, entertainment or similar event.
  • Such advertisements shall not exceed one square meter in area and shall not be displayed above four (4) metres from ground level.
  • No such advertisement shall be displayed earlier than seven (7) days before the first performance or opening of the event.
  • The advertisement must be removed on the last day of the event for which the permit was granted.
  • Advertisements must not obstruct road traffic signals, railways, inland waterways, metro signals or airfields.

Enforcement & Removal

Procedure when advertisements are displayed without a permit
  • Where an advertisement is displayed without a permit, the Area Council shall serve an enforcement notice (Form G) on the owner or occupier.
  • If the notice is not complied with within the specified period, the Area Council may remove the advertisement at the owner's expense.
  • Any advertisement board declared to be dangerously displayed shall be demolished immediately by the Area Council.
  • A person aggrieved by an enforcement notice may appeal within the period specified in the notice — the Area Council's decision shall be final.

Advertisements displayed prior to this Bye-Law may continue for three (3) months from commencement, during which application for a permit must be made. If no permit is issued, the display must cease at expiry of three months.

Offences & Penalties

Fines and imprisonment for contravention
Fine not exceeding ₦20,000.00 or imprisonment not exceeding 3 months, or both
Fine of not less than ₦50,000.00

In the case of a continuing offence, an individual shall be liable to a fine of ₦1,000 for each day during which the offence continues after conviction.

Exemptions

Advertisements not subject to this Bye-Law
Advertisements relating specifically to a pending General Area Council or Bye-Election
Advertisements required by any enactment or standing orders of national, state or Area Council authority
Traffic control, guidance or safety signs authorized by the Secretary/Director of Transport, FRSC, or authorized Police Officer

Definitions

Key terms under this Bye-Law
  • "Advertisement" means words, letters, model, sign, placard, board, notice, device or representation, whether illuminated or not.
  • "Existing Advertisement" means any advertisement being displayed prior to and at the date this Bye-Law came into force.
  • "Owner" or "Occupier" means the person who owns or maintains the display, the owner or occupier of the land on which the advertisement is displayed, and includes any person whose goods, trade or business is being advertised.
