Regulation of Public Toilet Establishments and Waste Disposal within Bwari Area Council
Public Toilet Bye-Law No. 17 of 2016
Part XVIII — Bwari Area Council FCT Abuja, NigeriaPursuant to the provisions of Section 7 and the Fourth Schedule to the Constitution of the Federal Republic of Nigeria 1999, and other relevant Sections of the Local Government Act, Laws of the FCT Abuja 2006, this Bye-Law regulates the establishment and operation of public toilets and bathrooms within the territorial jurisdiction of the Bwari Area Council.
Establishment & Permit Requirements
Sections 1 & 2 — Approval & FeeIt shall be an offence for any person or group of persons to establish or operate a public toilet/bathroom without approval from the Council.
- Any person wishing to establish or operate a public toilet/bathroom shall seek approval from the Council before commencing operation.
- The owner of an approved application shall pay a prescribed fee as determined by the Council, depending on the size of the structure to be used.
- A prescribed annual renewal fee shall be paid for the renewal of the Permit/License.
Management of Government-Owned Toilets
Section 3 — Council & Agent ManagementGovernment-owned public toilets shall be managed by the Council, or the Council may allocate management to an agent or contractor on terms specified with the prescribed fees to be paid every month. Any allottee found wanting shall have their approval/license withdrawn.
Duties of Operators
Section 4 — Maintenance & Waste Disposal- The operator shall clean and maintain any drain, side walls, front and rear of the public toilet.
- The operator shall provide a suitable holding tank for liquid waste or sewage liquor and ensure regular evacuation and disposal of same.
- No person shall cause or permit any trade or sewage effluent or liquid waste to be discharged into any drain, road, watercourse or any part thereof except at a place authorized by the FCT Abuja or the Area Council.
Private Dislodging Tank / Vehicle Licensing
Section 5 — Registration Requirements- Any private dislodging tank/vehicle owner who wishes to operate within the jurisdiction of Bwari Area Council shall register with the Environmental Health Department at a fee of ₦100,000.00 (One Hundred Thousand Naira).
- The license shall expire on 31st December of the year of issuance.
- Any dislodging vehicle owner that operates without a license is guilty of an offence and on conviction is liable to a fine of ₦70,000 (Seventy Thousand Naira) or three months imprisonment, or both.
General Prohibitions
Sections 6–8 — Structural Integrity & Use Restrictions- No person without the authority of the Council shall damage, remove, block up, or alter the fixed position or arrangement of any pipe, valve, tank, or other fittings in any public toilet, or willfully destroy, deface or damage any part of the structure.
- The agent/contractor shall ensure constant repair of commodes, sinks, tanks and other plumbing work in the public toilet.
- Toilets in premises designated for dwelling shall not be used as public toilets.
