Regulation of PSP Refuse Operators and Waste Management within Bwari Area Council

Part XXII — Bwari Area Council FCT Abuja, NigeriaPursuant to the provisions of Section 7 and the Fourth Schedule to the Constitution of the Federal Republic of Nigeria 1999, and other relevant sections of the Local Government Act, Laws of FCT Abuja 2006, this Bye-Law regulates private sector participation in refuse collection, transportation and disposal within the Bwari Area Council.
Mandatory Engagement of PSP Refuse Operators
Section 1 — Obligation on Property Owners & OccupiersEvery owner or occupier of premises, buildings and tenements shall engage the services of a Private Sector Participation (PSP) Refuse Operator that is registered and/or licensed by the Bwari Area Council for the purpose of removal, transportation and disposal of refuse from such building, premises and/or operations within any part of the territorial jurisdiction of the Area Council.
Prohibited Acts & Offences
Sections 2–4 — Offences- Unregistered Operation: It shall be an offence for any unregistered PSP Refuse Operator to carry on business and/or operations within any part of the territorial jurisdiction of the Area Council.
- Illegal Disposal: It shall be an offence for any owner or occupier of any building or tenement to dispose of refuse other than through a PSP operator registered by Bwari Area Council.
- Obstruction: It shall be an offence for any person, whether an individual or a body corporate or unincorporated, to obstruct a registered and/or licensed PSP Refuse Operator or its agent or delegate in the process of performing their legitimate duty of refuse collection.
