Market Regulation Bye-Law — No. 13 of 2016

Part XIV — Bwari Area Council FCT Abuja, Nigeria

Pursuant to the provisions of Section 7 and the Fourth Schedule to the Constitution of the Federal Republic of Nigeria 1999, and other relevant Sections of the Local Government Act, Laws of the FCT Abuja 2006 and all other laws enabling it in that behalf, the Bwari Area Council hereby makes the following Bye-Law.

Establishment & Control of Markets

Sections 1–4 — Approval, Management and Hours

Approval Requirement

No person shall establish or maintain a market without the approval of the Area Council. All markets established within the territorial jurisdiction of the Area Council shall be under the control and management of the Area Council.

Contravention: Any person who contravenes this provision shall be liable on conviction to a fine of ₦100,000 or 3 months imprisonment or both. Such market shall be closed/sealed up until written approval is obtained from the Area Council.

Market Opening Hours

Markets shall be opened on such days and between such hours of the day as the Area Council may approve.

Tolls and Stallages

Tolls and stallages fixed by the Area Council from time to time shall be paid by all persons selling or carrying on trade or stalling in the market. All tolls and stallages shall be paid monthly, quarterly, or half yearly in advance to the revenue Collectors of Bwari Area Council Treasury.

Market Rules & Obligations

Sections 6–20 — Conduct, Structures and Cleanliness
  • No person shall erect a stall, shed, building, wall, fence or enclosure within the market or within 3 metres of the market boundary without approval of the Council.
  • No person shall make any alteration in any stall, building, fence, wall or enclosure within any market without the approval of the Area Council.
  • All stalls, sheds, buildings, walls, fences or enclosures constructed after the date of application of this Bye-Law shall conform in all respects to the requirements of the Area Council.
  • No stall holder shall assign, sublet, or otherwise part with possession of the stall or any part thereof except with the prior consent of the Area Council.
  • No stall in the market shall be used as a dwelling place.
  • No person shall constitute a nuisance in the market.
  • Every occupier of a stall, table or place in a market shall keep the same in perfectly clean state and after close of every day's business, brush, sweep and clear away all dirt and filth, and dump same in the refuse bag.

Penalties & Sanctions

Sections 7–17 — Specific Fines by Offence
Trading without paying tolls/stallages (trespasser)₦50,000 or 3 months
Trading on unapproved days or hours₦50,000 or 3 months
Unauthorized establishment of market₦100,000 or 3 months
Erecting unauthorized structures within market/3m boundary₦150,000 or 6 months
Any other contravention without specific penalty₦150,000 or 6 months

The Magistrate Court of any grade shall have jurisdiction to try offences under this Bye-Law.

Interpretation

Key Definitions under this Bye-Law
"Area Council" Means the Bwari Area Council.
"Fees" Means all monies payable to the Area Council under the provisions of this Bye-Law but shall not include fines or other penalties levied for contravention of any provision of this Bye-Law.
"Market Master" Means the person appointed by the Area Council to oversee the affairs of all markets within the Area Council.
"Stall/Shop" Means any erection permanently or temporarily designed to give the occupant(s) protection from weather or any construction affixed to the ground for the display of goods for sale.
