Tricycle (Keke) Motorcycle Commercial Uses Bye-Law — No. 16 of 2016

Part XVII — Bwari Area Council FCT Abuja, Nigeria

Pursuant to the provisions of Section 7 and the Fourth Schedule to the Constitution of the Federal Republic of Nigeria 1999, and other relevant Sections of the Local Government Act, Laws of the FCT Abuja 2006 and all other laws enabling it in that behalf, the Bwari Area Council makes the following Bye-Law.

As from the commencement of this Bye-Law, it shall be an offence for any person to operate a Tricycle popularly called "Keke" or a motorcycle for commercial purposes within the territorial jurisdiction of Bwari Area Council except in strict adherence and compliance with the provisions of this Bye-Law.

Registration Requirements & Fees

Sections 2–5 — Registration, Annual Fees and Daily Operations

Registration Requirement

Any person who seeks to operate or who operates a motorcycle or a tricycle for commercial purposes within Bwari Area Council shall register it within the Area Council to ply designated routes. Registration shall be the basis for lawful commercial operation.

Definition of Tricycle (Keke)

A Tricycle (Keke) for the purposes of this Bye-Law means a three-wheeled, motor-driven contraption intended to carry two or more passengers.

Safety Requirements

Section 6 — Equipment and Roadworthiness

All Tricycles and motorcycles used for commercial purposes must:

  • Possess all safety equipment including helmets.
  • Be in good operating condition at all times.

Offences & Penalties

Sections 7–8 — Fines, Imprisonment and Jurisdiction

Penalty for Contravention: Any person who contravenes the provisions of this Bye-Law shall be guilty of an offence, tried summarily, and on conviction be liable to a fine of ₦3,000 (Three Thousand Naira) or imprisonment for three (3) months or both.

The Magistrates Court established under the law of FCT Abuja shall have jurisdiction for the trial of offences under this Bye-Law.

Citation & Commencement

Operational Date — 5th January, 2016

This Bye-Law may be referred to as Tricycle (Keke) Motorcycle Commercial Use Regulation and Control Bye-Law 2016, and shall become operational with effect from the 5th day of January, 2016.
